Explanation of the rules of Istinbad in the work “Usul al-Pazdawi”

The article examines the rules of istinbat in the field of usul al-fiqh, which is the most complex branch of Islamic sciences, and their scientific and practical significance. The initial work related to this science was written by Muhammad ibn Idris al-Shafi’i towards the end of the 2nd century Hijri (8th century Gregorian). The understanding of religious texts and the process of deriving practical-legal judgments from them, including rules such as comparison, abrogation, and the prohibition of certain actions, were previously established in both practical and theoretical forms. Istinbat is the process of understanding, clarifying, and deriving the norms and rulings of Sharia from the texts of the Quran and Sunnah. In addition to perfect knowledge of the Arabic language, this work requires a thorough mastery of tafsir, hadith, usul al-fiqh, the consensus and disagreements of the Salaf scholars, and knowledge of the science of vocabulary and analogy. This article examines the principles of inference outlined in the work “Usul al-Pazdavi” by Fakhr al-Islam Ali ibn Muhammad Pazdavi (1009-1089). Additionally, it analyzes the conditions and rules for deriving legal judgments from hadith based on the Hanafi methodology.
