The Contribution of Mawarannahr Scholars to the Development of Fiqh

This article presents a scholarly analysis of the role of the scholars of Mawarannahr in the development of the science of fiqh and their significant contribution to the advancement of Islamic jurisprudence, based on primary sources. Within the scope of the study, the formation of the sciences of hadith and fiqh in the region, their institutional and intellectual foundations, as well as the positive influence of the Iraqi and Khurasani scholarly schools on this process are examined in detail. The results of the scientific cooperation between scholars of these two schools are shown to have manifested positive outcomes over the centuries. In addition, the article emphasizes that factors such as the scholarly environment that emerged in Mawarannahr, the madrasa educational system, the social respect for scholars, and political stability created favorable conditions for the development of fiqh in the region. The article also analyzes, from a scholarly perspective, the contributions of major scholars such as Imam al-Bukhari, Imam al-Maturidi, Burhan al-Din al-Marghinani, and Abu al-Layth al-Samarqandi to the development of hadith studies and the science of fiqh. In particular, through their works the article examines the close relationship between hadith and fiqh, the application of theoretical legal principles in practical life, and the methodological foundations of the Hanafi school of law. It also demonstrates that the Mawarannahr school of fiqh effectively employed legal methods such as qiyas, istihsan, and ijtihad, harmonizing theoretical jurisprudence with practical judicial practice and the issuing of fatwa. Furthermore, the article analyzes the regional and international influence of the Mawarannahr school of fiqh. It substantiates that the scholarly legacy of Mawarannahr played an important role in the spread of Hanafi legal traditions in Central Asia, India, and the Ottoman lands. In this process, the madrasa institution served as a key mechanism for the continuous transmission of scholarly knowledge and the broad dissemination of the fiqh tradition. The study concludes that the scholarly tradition formed by the scholars of Mawarannahr was not limited to their own historical period but also exerted a strong influence on the subsequent development of Islamic jurisprudence. The vast intellectual heritage they created is evaluated as an important source that contributed to the systematization of fiqh, the strengthening of its theoretical and practical foundations, and the sustained development of legal thought.
